Mediation is a process in which a neutral individual is selected by the parties in a dispute to assist them in negotiating a resolution of that dispute.
The goal of the mediation process is to settle the dispute. Once an agreed settlement has been achieved the involvement of the mediator comes to an end.
The mediator is not responsible for ensuring that the actions in the mediation agreement are carried out as this is the responsibility of the two parties involved in the dispute.
Mediation should not be confused with arbitration. In mediation the role of the mediator is to facilitate the parties’ settlement discussions. In arbitration the parties give the arbitrator authority to hear the evidence and then render a decision which the parties are then bound to follow.
